A 77-year-old male resident of Residential Care Facility for the Elderly with advanced dementia suffered a major traumatic injury resulting in displaced, comminuted fractures of the right hip. The facility had no record of a fall. The resident’s wife found him to be in excruciating pain in his bed three days later. Facts came out in trial that caregivers had put him in bed after a fall and reports of the incident were never provided during the lawsuit. A judgment for $1,167,000.00 was entered following a jury trial.
