Nursing Facility Sued for hiding Rotting Leg Infection From Surgeon, Costing Patient Years of Surgeries and Permanent Disfigurement — $5.5 Million Settlement

A 42-year-old male became a resident at Skilled Nursing Facility after suffering a traumatic injury due to a vehicle vs. pedestrian collision. After undergoing intensive surgery, the doctor saved one of the man’s legs before he was transferred to the facility to rehabilitate. At the facility, his leg became infected, but the facility did not notify the operating surgeon despite the stench of the rotting leg. During a routine check-up at the hospital, the infection was noted and the man underwent multiple surgeries, deformities, skin grafts, and an additional two years of recovery with permanent disfigurement. Case settled for $5,500,000.

NURSING FACILITY FAILED TO PROVIDE PROPER WOUND CARE AND PRESSURE ULCER PREVENTION, RESULTING IN SEVERE SACRAL PRESSURE INJURY — $1.675 MILLION RECOVERY

A 78-year-old gentleman was admitted to a Skilled Nursing and Rehabilitation Facility following a hip fracture. During his stay, the facility failed to provide appropriate wound care and treatment, failed to adequately turn and reposition him, and neglected his nutritional and hydration needs. As a result of this neglect, he developed a severe unstageable pressure ulcer to his sacrum. The matter resolved for $475,000 against the skilled nursing facility and $1,200,000 against an additional skilled nursing facility, for a total recovery of $1,675,000.

Assisted Living Facility Failed to Report Fall, Left Dementia Patient in Agony for Three Days — Jury Awards $1.17 Million

A 77-year-old male resident of Residential Care Facility for the Elderly with advanced dementia suffered a major traumatic injury resulting in displaced, comminuted fractures of the right hip. The facility had no record of a fall. The resident’s wife found him to be in excruciating pain in his bed three days later. Facts came out in trial that caregivers had put him in bed after a fall and reports of the incident were never provided during the lawsuit. A judgment for $1,167,000.00 was entered following a jury trial.

Nursing Home Patient Died After Suffering Severe Malnutrition and Dehydration While Rehabbing for Hip Surgery – Family Receives $800,000

Another 79-year-old female resident was at a Skilled Nursing Facility for rehabilitation after hip surgery. During her stay, she lost approximately 40 pounds due to malnutrition and dehydration.  After reviewing her labs upon discharge from the facility, a medical expert drafted a written report indicating that the case should be reviewed by the district attorney for potential manslaughter charges. Five days after her release from the facility, she died from acute renal failure due to the malnutrition and dehydration. Case settled for $800,000

Elderly Man Fell Three Times in Care Facility, Left in Soiled Diaper and Pain While Family Was Never Notified — $725,000 Settlement

A 91-year-old a resident of Residential Care Facility for the elderly had a fall, striking his head and body and sustaining multiple left-sided rib fractures. Within a few days of first fall, he suffered two additional falls with personnel failing to notify his care-giver and personal representative.  His injuries included a displaced, fractured left hip. He was found in soiled diaper and great deal of pain prior to being transferred to ER by ambulance.  Case settled for $725,000

Nursing Home Sued for Letting Alzheimer’s Patient Starve and Dehydrate for Months — $600,000 Settlement

A 79-year-old woman at a Skilled Nursing Facility with Alzheimer’s disease suffered from malnourishment and dehydration when care givers failed to ensure she ate and had fluids during her 3 ½ month stay at facility. Eventually, she was taken to the emergency department with major complications related to lack of food and water. She never recovered from the near death experience, passing away four months later.  Case settled for $600,000

Assisted Living Facility Sued for Ignoring Regulations, Kept Resident With Worsening Wound Until Leg Amputation Was Unavoidable — $450,000 Settlement

A 71-year-old male resident at a Residential Care Facility for the Elderly (“RCFE”) was not discharged despite the fact that he had a Stage III pressure ulcer on his foot. Under California state regulations, this is a prohibited condition at an RCFE and the facility was required to discharge him to a facility that could provide medical care necessary for the wound. The facility chose to keep him as a resident despite the worsening wound. The wound became infected. By the time the resident was released to the Emergency Department, it was too late for his lower extremity which was amputated below the knee. Case settled for $450,000.

Girl Sexually Molested for Four Years While in State Foster Care — $4.25 Million Settlement

Between the ages of 12 and 16, a young girl was sexually molested while in the custody and control of a Foster Home. Case settled for $4,248,250.80

Elementary School Teacher Sexually Molested 8-Year-Old Student — $750,000 Settlement

An 8-year-old was sexually molested by her elementary school teacher. Case settled for $750,000.

School District Found Liable After 14-Year-Old Sexually Abused by Uncle — Jury Awards $734,200

A 14 year-old was sexually abused by her uncle while in the care and custody of the School District.  The case went to trial.  Jury awarded $2,609,200 with School district being 25% at fault.  Judgment against school district was in the amount of $734,200.

Cyclist Crushed to Death by Tractor-Trailer on Dangerous City Road — $7.81 Million Settlement for Two Daughters

A  57-year-old female cyclist was struck by a tractor trailer pushing and pinning her against curb. The rear end tires of tractor trailer ran over her helmeted head, crushing her to death, leaving two young adult daughters as her survivors.  Case settled against the City for dangerous design and the trucking company for the driver’s negligence for a total of $7,810,000

DEPENDENT ADULT SUFFERED CATASTROPHIC PRESSURE INJURIES AND OSTEOMYELITIS AFTER NEGLECT AT CARE FACILITY — $1.06 MILLION RECOVERY

A 42-year-old dependent adult suffered devastating neglect during a nine-week stay at a skilled nursing facility. Due to the facility’s failure to provide proper care, he developed multiple severe pressure injuries requiring multiple surgeries and extensive medical treatment over many months. As a result of the neglect, he was left with osteomyelitis of the tailbone and permanent, catastrophic tissue loss to his lower back and sacral area. The matter resolved for $189,519.92 against a congregate living facility for the elderly and $875,000 against a hospital, for a total recovery of $1,064,519.92.

SKILLED NURSING FACILITY FAILED TO PREVENT DIABETIC FOOT ULCERS AND INFECTION, RESULTING IN MULTIPLE AMPUTATIONS — $475,000 RECOVERY

A 71-year-old diabetic man was admitted to a skilled nursing facility following a brief hospitalization. He had a medical history significant for gout, diabetic neuropathy, and a prior amputation of his right great toe. At the time of admission, he had no arterial or venous ulcers, diabetic foot ulcers, or other open wounds.

Despite his known high-risk condition, the facility failed to provide appropriate monitoring, preventative care, and treatment necessary to protect him from diabetic ulceration and infection. As a result of this neglect, he developed osteomyelitis in his left great toe, ultimately requiring amputation. The infection subsequently spread to the second and third metatarsals, leading to additional amputations and permanent injury. Case resolved for $475,000.

Nursing Home Injured Resident’s Toes, Ignored the Wounds Until Infection Forced Leg Amputation — $400,000 Settlement

An 80-year-old male resident at a Skilled Nursing Facility was admitted for healing and rehabilitation. While a resident, he sustained injury to two his right toes while being hoisted in a Hoyer Lift. No treatment was provided for the injuries resulting in infection.  His right  leg was amputated below the knee to treat an ankle abscess with osteomyelitis of foot and lower tibiae resulting from the injected right toes.  Case settled for $400,000
